All contracts for the purchase of products concluded through the website "https://poggionarnara.com/" are governed by these General Terms and Conditions.
Whenever an order is placed on the website https://poggionarnara.com/, it will be required to accept the General Terms and Conditions in effect on the date of its inclusion.
All prices published on the website https://poggionarnara.com/ are given in euros and are understood to be public prices. POGGIO NARNARA reserves the right to change prices at any time, without prior notice.
Order modalities and acceptance of the General Conditions

Acceptance is deemed tacit, unless otherwise communicated in any way to the Customer, who is always required to communicate his own address, under penalty of inexecutability/nullity of the order received, at the sole discretion of POGGIO NARNARA.

Correct receipt of the order is confirmed by POGGIO NARNARA by means of a reply sent to the (email) address provided by the Client. This confirmation message will include the Date and Time of receipt of the order and a 'Customer Order Number', to be used in any further communication with POGGIO NARNARA. The message will repeat all the data entered by the Client, who undertakes to verify their correctness and promptly communicate any corrections.
POGGIO NARNARA reserves the right to refuse orders from Client with whom a dispute has arisen in relation to one or more orders previously placed, or in the event that POGGIO NARNARA believes, in good faith, that the Client has violated these General Conditions or is engaged in fraudulent activity or for any other reason that POGGIO NARNARA may deem legitimate.
In the event of non-acceptance of the order, POGGIO NARNARA undertakes to promptly notify the Client.
The Client may check the status of his order by accessing the web area dedicated to him under "Order Status".

Thereafter, POGGIO NARNARA will send the Customer, via e-mail, a summary of the order. The notification of receipt of the order will indicate the description of the POGGIO NARNARA products, the number of products chosen, the price of the products ordered, as well as the amount of transportation costs.
For each Customer, when placing the first order, it is necessary to create an account for the purpose of saving billing and delivery data that may come in handy for a subsequent order. Methods of delivery

Methods of payment

All orders are payable in euros.
In the event that some of the products ordered are not available, only the price and shipping costs related to the available products will be charged.

Retention of Title

Delivery Area.
Products will be shipped to the address indicated by the Customer during the purchase procedure, unless otherwise agreed between the parties, to be defined through Customer Service.
Freight charges and delivery terms
During the purchase procedure, you will be asked to choose the mode of shipment of the products.
The total cost of shipping up to the Customer's domicile shall be borne by the Customer.
Shipping costs will be determined depending on the delivery service chosen by the Customer, the products and the country of delivery.

During the purchase procedure, the terms and possible shipping methods will be indicated with reference to the purchased products and delivery countries. The relevant amount will be due from the Customer in addition to the price of the purchased products.
Delivery problems
In the event of non-delivery or delay in delivery of more than eight (8) working days, the Customer must inform POGGIO NARNARA immediately.
Claims sent more than ten (10) calendar days after the date of acceptance of the order will not be accepted.
The Client must check the conformity of the products upon delivery and must report any defects found (opened package, damaged product, etc.) by means of a complaint signed by the Client himself, possibly on the delivery note, then contacting Customer Service by e-mail at info@poggionarnara.com
If the delivered products do not conform to the order or for any reason do not satisfy the Customer, the same may return them, requesting an exchange of the product or a refund, or exercise the right of withdrawal as better specified below.

Right of withdrawal
The Customer may exercise the right of withdrawal in the event of delivery errors or damaged products, by returning the goods received and obtaining a refund of the price paid, without penalty, within the period of ten (10) working days from the day of receipt of the purchased product.
To exercise the right of withdrawal the customer must, within the same period send an e-mail confirming the manifest withdrawal.
POGGIO NARNARA will accept the returned goods reserving any refund only after verifying that the products have been returned in their original state, unused and with the original packaging intact. Only in this case POGGIO NARNARA will forward the amount paid by the Customer for the purchase of products.
POGGIO NARNARA will refund the customer the full amount already paid within thirty (30) days from the date of receipt of the goods subject to withdrawal and the relevant communication, by transferring the amount charged to the Credit Card or by Bank Transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN Code of the Current Account of the invoice holder and its beneficiary).

The right of withdrawal is subject to the following mandatory conditions:
The Purchased Goods must be intact and returned in the Original Package, complete in all its parts (including the Presentation Folder, Transparent Envelope and Closing Ribbon); To Limit Damage To The Original Package, We Recommend, As Much As Possible, To Put It In A Second Envelope, On Which To Affix The RMA Number Issued By POGGIO NARNARA; In All Cases It Is Prohibited To Affix Labels Or Adhesive Tapes Directly On The Original Product Package;
The Goods Subject To The Exercise Of The Right Of Withdrawal Must Be Returned In Normal State Of Preservation, As Has Been Stored And Eventually Used With The Use Of Normal Diligence: Will Not Be Accepted Used Products That Show Signs Of Wear Or Dirt And That, As A Result, Can No Longer Be Considered Intact;
The Shipment, until the certificate of receipt in our warehouse, is under the full responsibility of the customer;
In the event of damage to the goods during transport, POGGIO NARNARA will notify the customer of the incident (within 5 working days From Receipt of the Goods in their Warehouse), in order to allow them to make a timely complaint against the Courier of their choice and obtain a refund of the value of the Goods (if insured); in this case, the Product will be available to the customer, at the same time canceling the withdrawal request;
POGGIO NARNARA is not liable in any way for damage and/or theft/loss of goods returned by uninsured shipments.
The Customer totally forfeits the right of withdrawal, for lack of the essential condition of integrity of the goods (packaging and / or its contents), in cases where POGGIO NARNARA ascertains:
The Lack Of The Outer Packaging And/Or The Original Internal Contents;
The Absence Of Elements And/Or Anomalies To The Product Itself;
Wear and tear of the Product, which has compromised its integrity.
The costs and risks of transport for the return of the product being returned are fully borne by the Client, who, directly or by other means, will deliver them to the domicile of POGGIO NARNARA.
Transportation costs incurred for the delivery of the product to the Client and for any return to POGGIO NARNARA are not refundable.

The return of products that are not intact, deteriorated or lacking original equipment will not be accepted by POGGIO NARNARA and will be returned to the sender with additional shipping costs.
In the event of forfeiture of the right of withdrawal, POGGIO NARNARA will return to sender the purchased goods, charging the same shipping costs.
All products must arrive in the identical condition of receipt.
Contract termination, express termination clause, exclusion of liability
POGGIO NARNARA reserves the right to terminate the contract entered into by giving simple notice to the Client indicating the reason. In this case, the Client will be entitled only to a refund of any amount already paid.
The obligations assumed by the client, as well as the guarantee of the successful completion of the payment that the client makes by the above mentioned means, are essential in favor of POGGIO NARNARA, so that by express agreement, the failure by the client to comply with only one of these obligations will result in the legal termination of the contract under art.1456 c.c., without the need for judicial decision, without prejudice to the right for POGGIO NARNARA to take legal action for compensation for further damage.

Any right of the Customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages is excluded, and in particular, by way of example, for loss of business, profit or opportunity resulting from or consequent to the purchase of products on the website https://poggionarnara.com/ . , to persons and/or property, related to the execution and/or non-acceptance, even partial, of an order and this also for reasons of stock shortage or unavailability of products.
No responsibility can be attributed to POGGIO NARNARA for delayed or non-delivery attributable to force majeure or fortuitous events.
POGGIO NARNARA is not responsible for damages caused by the carrier to the purchased products.
